Youll never find a little starryeyed 5year old child say “when I grow up I want to go into foreclosure” but nevertheless hundreds of thousands of families are facing the unthinkable today. Many times one or more people involved would rather deny the reality of their financial situation which may have been how they got there in the first place. However denial only leads to delay which perpetuates the disaster and leaves you with fewer options. Your other alternative is to be courageous enough to face reality and work through it making your outcome much more favorable and your family much stronger. Here are a few ways denial can affect foreclosure:

1. Stop The Madness
If you dont realize the propensity of the situation you will continue to borrow money that you cant pay back live beyond your means and dig the hole deeper. Once you get beyond denial you can do a 180 and begin a new focus financial freedom.

2. Negotiate in Truth

Banks and lenders are not prepared to negotiate with those who are perpetuating their financial crisis through denial. By recognizing the truth you can begin to avoid foreclosure through negotiated methods. The lender does not want your house they would much rather have your payment. They are usually willing to work out a realistic payment plan to keep you in the mortgage. Another option is a short sale where the lender agrees to discount the loan balance in exchange for you selling the home and giving them the proceeds. Get out of denial and on to negotiating.

3. Relationships Need Truth

When facing any type of financial crisis the whole family feels the effects. By denying the situation your family and relationships learn an important lesson “when things get tough deny they exist.” When you face it with courage and deal with the truth openly by learning from your mistakes your family learns an even more important lesson. When denial and lack of communication exists relationships begin to deteriorate under the pressure.

When foreclosure is a threat dont become a victim of denial. The sooner your face the truth the sooner you are on a road to financial freedom.

The cases are relate to “employers liability insurance” – the insurance policies which are often claimed against by asbestos victims who develop diseases several decades after they were exposed by their employers.

In most cases, the insurer who provided policy to the victim’s employer at the time they worked for them, has always paid out compensation. However, some insurers are now refusing to pay up arguing that the correct interpretation of their policy means they only have to pay up when the victim develops an “injury”. The insurers argue that the real “injury” does not occur until a tumour develops, often decades later.

This follows a Court of Appeal decision in relation to “public liability insurance” (Bolton MBC v Municipal Mutual Insurance Ltd, 2006) in which the Court found that a policy for public liability, i.e. visitors or non-employees, was only invoked when the victim became “injured” decades later.

The implications of the High Court test cases are potentially devastating to asbestos victims. Asbestos was extensively used in UK industry until the early 1980’s. However, due to the latency period of asbestos diseases, symptoms do not appear until anything between 10 and 60 years later. During that time, many former employers have gone out of business and no longer exist.

If the argument raised by the insurers is accepted, victims will be forced to claim against the more recent insurers. However, if the employer no longer exists, there will be no insurance policy in place and the victims will be left with nobody to claim against. This is despite the fact that decades ago, employers took out insurance policies in good faith to provide cover for their employees.

The High Court test cases are expected to last for at least nine weeks and it may be many weeks after that before the Court gives its final judgment. Even then it is expected that this case will be fought all the way to the House of Lords and the real issue may not be concluded until 2009 or even 2010. While the case is argued, time is running out for the many asbestos victims who have been given a limited prognosis as a result of the devastating effects of mesothelioma.

The case has attracted the attention of Parliament with the insurance industry coming under heavy fire from some MPs. Michael Clapham MP referred to the insurers as ‘jackals’ and accused the industry of ‘hypocrisy’. Jim Sheridan MP said asbestos victims are “being treated worse than cattle”.

Daniel Easton, Partner in the Industrial Disease Department, comments as follows:

“This is a cynical attempt by the insurance industry to avoid paying out on their policies. We were repeatedly assured during the pleural plaques litigation that insurers wanted to properly compensate mesothelioma victims. Given this recent attack on asbestos victims, that clearly does not seem to be the case.

We have no option but to fight all of our mesothelioma cases to court, not knowing whether the insurance policies behind the Defendant will pay out at the end of the day or not. This simply heaps uncertainty onto a vulnerable section of society who do not know whether they, and their families, will be compensated for the fact that their employers failed to protect them years ago. Tragically, there are bound to be many victims who will die before this argument is concluded, not knowing whether the insurance companies will make good on their policies or not.”

Potential homeowners who are actively searching for a viable home design, usually find a good solution in a stock house plan. This is not to say that the plan is perfect; rather, it will likely meet the needs by which the homeowner can live with. If changes are needed, making modest modifications to the blueprints can solve some of these issues. If the changes are simple like changing a door location or window size, your builder can easily mark these changes directly on the plans without any problem during the construction process. Even moving a non load-bearing wall a foot or two isn’t such a big issue. It is the more complex design changes that will require the help of your building designer. 

Modifications are wonderful, but not always the best choice for homeowners who want to change the scope of a home’s design. There comes a point where some changes can become counter-productive. As mentioned above with the door and window modification, these are easy cosmetic changes. Requiring structural changes is where you begin to consider the limits of what can be done to the home plan design. There are two factors that always determine whether or not a design can or should be altered, the level of modifications, and the cost of modifications. 

The Level of ModificationsNot all ideas are worthy of consideration when it comes to redesigning a stock plan. Although computers make it much easier to do plan modifications, making changes to a completed work is still a delicate task. If you have ever seen a set of plans, you know that it is packed full of information on every sheet including the floor plans, elevations and building detail drawings. This is also why you will notice a warning or disclaimer about making alterations to the design. A sample statement may say, “Any design changes should be performed by a qualified building designer, architect, or engineer, as even minor changes in one area of the design can lead to major problems in another part of the design”. This more or less advises you that forward and critical thinking is needed to avoid the pitfalls of making in-depth structural changes to the design. 

Keeping the level of modification low is best, but knowing the extent by which a design can be modified determines if it is even a good idea to do so. A wish list to shift or move exterior & load-bearing walls, redesign the roof, move a room to a different location, and change a few other essential design components is a pretty extreme on level. First, making these changes together will completely redo the original design in many cases. Second, the effort put into it will require many hours of work in order to peel back the layers of the design to make sure all connecting parts and details are updated accordingly. In comparing this to a custom design, you are subject to spend just as much time in redesigning and updating the stock plan. So if you spend an absorbent amount of time in extensive modifications, guess what else you are going to spend a lot of, money. 

The Cost of Modifications If the cost to modify a stock plan begin to rival the cost of a custom design, then you have two choices, either go custom or continue searching for a stock plan that require little to no change. On average, typical plan modification charges can range from several hundred to a couple of thousand dollars. This is in addition to the cost of the original plan itself and the work can usual be completed in as little as a day, or in the span of a few days. This also take into account that the modifications are moderate, lacking any serious design alterations involving major structural changes. By all accounts, these dollar figures and time frame are reasonable when we talk about modifying a stock home plan to meet your needs. On the other hand, if you feel that you have to make more design changes, then you may want to consider searching for another plan. You can be sure that your wallet will make you do so even if your heart ignore these limitations.
